Anyone that was around in the Napster days and when Sony included a rootkit on music CDs should not be surprised by their attitude on this.

Meanwhile their audio player hardware division wanted you to rip CDs to take with you on the go. What a fine time to be alive!

u/8bit_dr1fter Aug 25 '26 edited Aug 25 '26

What a fine to be alive!

Man that typo is just too perfect.

129

u/ScottIBM Aug 25 '26

Haha!

Sony:

Here, you can use it to take your music everywhere you go.

Also Sony:

No! Not our music!

u/Efficient-Session644 Aug 25 '26 edited Aug 25 '26

This was actually a big problem for them internally. They basically lost the timing to release their own Ipod because Sony Music were crazy about DRM and kept fighting their eletronics division.

81

u/Aidanation5 Aug 25 '26

Sony is the type of company that has repeatedly shown that they will happily fucking shoot themselves in the face as long as that means they can take as much consumer protections away, make the product with the least effort, care, and resources, and still get your money.

28

u/Efficient-Session644 Aug 25 '26

That's just the M.O for any big corporation. Get you in, then cut costs so they profit more.

22

u/Aidanation5 Aug 25 '26

They're still a standout in the industry especially as of late. They impress me a little more every time I read something about their fantastically intelligent decisions.

It's like when Netflix would tell people to share accounts

60

u/techieman34 Aug 25 '26

That’s just the normal life cycle of businesses like that. They start cheap and almost give it away to grow their user base. And all the better if they can squeeze out the competition while they’re doing it. As long as they’re rapidly growing the VC firms will keep pumping money into them. But once the growth starts to slow the VC companies will start expecting to see a return on their investment. So prices start to go up and the quality goes down.

15

u/DrManhattan_DDM Aug 25 '26

So you’re saying that I shouldn’t hold my breath for the triumphant return of MoviePass?

6

u/Metalgear696 Aug 26 '26

We've had almost 30 years of Playstation. I also doubt Sony is in such dire financial straits they're seeking venture capital. Sony is like a 100 year old company. This isn't normal anything.

6

u/techieman34 Aug 26 '26

I was responding to their comment that it was like Netflix and explained why it followed the path it did. Either way Sony is a business and is all about protecting their earnings and trying to make them grow.

19

u/Balmung60 Aug 25 '26

Yeah, but that was when they were full of VC money to build market share and those VCs could borrow money basically for free. Now interest rates are higher, the VC money is spent, and they need to make money, even if that means enshittifying to perfectly replicate the basic cable they replaced.

15

u/mlag000 Aug 25 '26

To make money ? Every years they make re ord profits and raise prices. It's just corporate greed

lets not pretend netflix was just a feisty little startup when they made the call to double their account price (literally what requiring another account means)

21

u/fractalife Aug 25 '26

They had this thing. Atrac3plus which I used heavily. You could fit like 2/3x more songs on a CD, and the sound quality didn't noticeably suffer (at least to me, at the time, with the headphones I had).

You could make folders on the CDs and the player had a scrollwheel and black and white LCD that let you search through your songs.

Hot shit back in the early aughts.

5

u/almisami Aug 25 '26

Atrac3plus was a thing on minidisk. Didn't know it was a thing on CDs!

Sony BMG initially denied that the rootkits were harmful. It then released an official uninstaller for one of the programs that merely made the program's files visible while also installing additional software that could not be easily removed, collected an email address from the user and introduced further security vulnerabilities

This cracked me up Lol

There is one difference, Steam doesn't care if you move to a new machine. I didn't own a PS3-5, did they allow you to transfer all of your games to each new playstation just migrating your account? If not, then Sony is behind Steam in that regard. Edit: Neat they stopped being dicks about it.

And I doubt GOG is different either. The only real difference I see is that if your license is pulled, so long as you had already downloaded it, there was nothing they could do to revoke your access to it. Now if that's legal, that's another question

GOG solves the "what if they go tits up" problem that digital games suffer from. And even then, I've noticed they've started letting in some DRM(And nobody is going to convince me that a "One time connection to gog galaxy to activate the content" isn't DRM). They really need to change the wording of their marketing if they're going that route, as it still says their stuff is DRM free

They shouldn’t be allowed to use the word buy then. Let’s stop letting companies redefine words to suit them.

658

u/ProgrammerNo3423 Aug 25 '26

I'd love to see that world actually. Imagine if they were required by law to say "rent". Like rent this game. Or maybe "buy license". People might still pay though, but damm that would be a major turnoff for most people.

226

u/Key-Leader8955 Aug 25 '26

They would understand what they were getting for their money.

202

u/chiksahlube Aug 25 '26

"License lease."

Would be the appropriate term.

23

u/Healthy_Turnip7352 Aug 26 '26

is it that sony licenses it also? that's why they remove it?

if that's the case, they need to legally change it so that users who buy it forever, can keep it forever.

"buy forever" should not mean "buy for a limited time period."

that would make it like my All You Can Eat buffet, which allows you to eat unlimited food up to a certain not-unlimited limit.

5

u/Giatoxiclok Aug 26 '26

Wellllll, you see. We never said ‘buy it forever’ we just said buy, which can be interpreted in many ways. You could buy access to something for a limited time, like we do now with everything! Isn’t that wonderful?

4

u/Serainas Aug 26 '26

So it’s actually one of those “win a lifetime supply of x” when the lifetime supply is a prescribed amount that you get for a prescribed time until the company doesn’t make that product anymore, then it’s oops sorry guess we’re all out 🤷

36

u/sonofaresiii Aug 25 '26

I'm well educated on the issue but I still fully understand the way psychology works and I'm absolutely certain there's a few impulse buys I'd have held off on if, right when I go to pull the trigger, the word "rent" pops up in front of my face.

I can't pass up a great deal, better buy it now and play it later. Oh wait, right, I'm renting it... Well, I can rent it later when I'm ready.

Anyone who claims they wouldn't be in some way affected is in denial and would probably be even more affected. This is just how psychology works.

→ More replies (1)

15

u/mliving Aug 26 '26

Exactly. For Sony to suggest, even in their "updated" TOS that they never sold me copies of the games installed on my PlayStation is patently absurd if not illegal.

This makes the right to repair and keeping games alive even more important if access to my "purchased" goods can be restricted by a change in the seller's TOS.

And they struggle to understand why people sail the briny sea! Honestly the unmitigated greed is repulsive.

34

u/that1dev Aug 25 '26

California already has that law sort of. You can't use purchase unless you're actually disclosing that it's a licence only. This is how Steam does it, for example.

I don't think it's slowed a single thing down. I doubt most people realize it's there. Everyone assumes it probably won't happen to them and that's the end of how much they care.

Steam

I still remember my first time, back when it was EB. Bought a copy of X-Men vs. Street Fighter "new." It was a damn good thing I suffered from poor impulse control and wanted to check it out just outside the store, because when I pulled it out of my bag it was not only open, there was no disc in it at all.

They even tried to push back on me because I'd left the store. They backed down when I pressed the fact that there was no way I wouldn't have been caught on cameras and offered to get security involved. Fuck that entire corporation.

A bit off topic...

My Mom is going to sign paperwork with a realtor for a retirement community. She wants me there cause.... I don't know. She must like conflict.

I am sitting there and the realtor keeps using that word 'Own' over and over again like she knows what it means.

I had had enough.

'Just stop. Please stop incinuating my Mother is going to own this house. You are confusing her. You are making her think that she can roll the money into something else in the future.

If she dies, does her estate get it? Nope. You get it. If she wants to move to an apartment can she take the equity from this house to an apartment? Nope. She has no equity. She has no right to equity. There is not equity for her.

You on the other hand. You get to sell this thing over and over and over again and only pay to have it built once.

Stop using that word, 'Own'. She owns nothing. Lease is the word you are looking for.'.

My objection was real. Every other day I had to explain to my Mom why she couldn't take the money she was 'investing' in this thing to move into an apartment when it felt too big for her. She just didn't understand.

So yeah, words mean things and we need to hold people accountable.

11

u/Key-Leader8955 Aug 25 '26

Yep. Companies love to redefine words to suite them and screw us.

19

u/SegaTime Aug 25 '26

So... what ended up happening with your mom? Did she still move into it?

50

u/Familiar-Banana-8116 Aug 25 '26

She moved in. It is a nice place. I just know how she is and at some point in like the next 5 or 6 years she is gonna be all like, 'I want an apartment because of 'reasons'. And we are going to have a shocked pikachu face when she is told, yet again, that she doesn't own the place, there is no equity and she has to start from square one.

It is inevitable.

Dig this.

So, after they are done explaining how you don't really own it they then offer a 'financial plan' to 'pre-buy' your next place.

When you pay for your residence, say, $300,000 or so, if you give them instead $400,000 or $500,000 they will 'hold' that money for you so you can use it for your next place.

You know.

Hold.

As in, you don't earn interest.

My mother kept talking about that like it was a good thing as well. I kept having to tell her to take the extra money, go to her financial person and ask if he can make an offer for greater then 0% interest.

I kind of like the place, but man, that stuff left a sour taste in my mouth.

15

u/SegaTime Aug 25 '26

That sour taste is a lack of transparency it seems. You might feel better about it if they weren't so slimy about it to begin with. At least she's doing good.

16

u/Aidanation5 Aug 25 '26

I mean, I would say that some of that sour taste is caused by actually predatory business practices and straight up abuse of the elderly and theft of their assets and funds by making them sign their lives away with huge complicated contracts?

I'm sure that the people who are hiring a team of people to help them continue being alive as they cant even take care of themselves anymore are fully capable of understanding and weighing the pros and cons of your theft and abuse agreement. Hospice care/nursing homes/retirement communities can be some of the most disgusting and worthless businesses ran by some of the most useless and evil "people" that you could find.

3

u/RaiKyoto94 Aug 27 '26

I went to the Microsoft Xbox store and it says Buy.

Under the options you have the terms and conditions and Digital sales conditions as well. Basically saying you don't own the software and it's only a purchase for a licence.

interesting it says you can request this agreement between the software provider for free.

I think it should be clear. Something like "Buy Licence" or "Rent" or the agreement on the page as well. I shouldn't have to request it.

Personal opinion: I've known how software licenses work and games and I know when I'm buying a game, I'm buying a licence to the game on that platform also. I also know games cost money to keep alive with server costs etc. I understand like offline games could be "buy" but sometimes they have legal agreements with the music etc to be used until the commercial life of the product.

If you have a multiplayer game, who is going to help keep it running, "police" it etc. Because when game servers go somewhat dead or no more updates then more hackers just come in and ruin it.

Would be good say if the Top ten games via player count was kept alive via the platform on behalf of Sony, Xbox etc then it makes sense because if a large amount of players are still playing then they can still get a 30% cutt off the store for DLC or in game buys etc.

3

u/foxmetropolis Aug 27 '26

This is precisely my take. The whole reason companies used the word “buy” - which has a well-understood definition and whose concept spans literally thousands of years of human history - is because they did not think their customers would like the sounds of “lease”, “lifetime lease” or “rent”.

They intentionally manipulated the language to mislead the consumer, and then changed the fine print to redefine their terms, knowing full well that jargon went right over their consumers’ heads. Knowing full well that transparent language would have been received poorly, or led to different buying practices. Or boycotting.

Instead, they baked a contradiction into their contracts. That isn’t business, it’s deceit and fraud; you aren’t usually allowed to directly contradict the meaning of bold large-text claims with fine print contract jargon. But because technology was new and shiny, they convinced lawmakers and legal experts that it was legitimate.

It’s been anti-consumer from the beginning. It should 100% be changed back so the terms are literal.

I skipped the PS5 and was going to wait for the PS6, but since KH3 and GTA are both announced I looked into a PS5, again not knowing hoe much they’ve risen in price the last year or so. Holy shit. Knowing what I know now, I won’t be buying one and I’m not serious enough about gaming to build my own PC. I’m bummed.

I stopped playing for it. At this point, I don't I'll ever give them want money again, for anything. I'm tired of corporations being pieces of shit.

Then they shouldn't be allowed to use words like "purchase" or "buy" in the game market.

This is one of those situations involving the possession and consumption of cake. If they're not actually selling it, they shouldn't be allowed to advertise it as a sale.

9

u/00negative Aug 26 '26

Class action lawsuits should be filed on this sort of shit, just like Amazon prime taking content you that you have purchased because they lost it in their catalog. We pay for these on your service they should be available to users that pay for it whether they have it publicly available still or not

Consumers are getting f**ked at every turn. Or we need to stop buying online, streamed products and go back to hard copies. Might be a perfect new business model. What is old is new again.

u/christopher1393 Aug 25 '26

If buying is not owning then piracy is not stealing.

Then don’t call it a purchase

7

u/jikanetbasedborn77 Aug 26 '26

And then, Players reminds Sony they don't actually own the money they sold

6

u/DemonikAriez Aug 25 '26

That language has been in gaming EULAs/ToS for years. It's not equivalent to Sony suddenly announcing, “You don't own anything you bought.”

2

u/BlueFeathered1 Aug 26 '26

Except they just did. They made a point to remind people "out of the blue". Which comes across as more hostile fuck-yous to customers, considering the climate right now.

At least I have more control of my physical media.

15

u/Top-Tax6076 Aug 25 '26

Unlike steam, which literally is the same

5

u/koalazeus Aug 25 '26

It's an issue on steam too. It's better on gog. Sony did have physical games which are also a good option. They've announced they're stopping making them. Hence the complaint.

6

u/blackblades75 Aug 25 '26

Which should be fought and changed to own. Apparently people forgot how to fight back. They rather sit back and take it like a champ. Seriously some people trying to fight it but you have majority of others whining about them fighting everyone rights to own.

Nobody owns any game or software they purchase. You only own the license to own a copy be it in digital or physical form. It's the reason why if you broke the disc or lost it, or it just flat out stops working after many years, you aren't entitled to another free copy. It's also why you're not allowed to make copies and sell them for personal gain. If you truly owned the game that means you could make copies and sell it or do what you wanted with the IP.

Im not arguing in defense of them taking physical media away. I still think it's important to not have companies meddle with games in your library and people should be allowed to resell the copy they purchased if they no longer play it. But I think people are confusing what it means to buy a game. You buy a license and it's always been that way. Yes, I guess they shouldn't consider it "buying" but it's not exactly renting either. You're buying access to a copy that lasts for as long as the physical media lasts for, but that's not really an issue for digital media since it's tied to an account and/or downloaded onto a device which can be transferred if the device breaks

Companies are trying to control your access to these games in a digital library by creating arbitrary time limits for offline accounts to gaslight people into believing the reason to take away something you rightfully paid for. That's the real issue here. It doesn't make them money if your games never expire, forcing you to buy them again. I think having a digital copy is great. I like physical too but this is just greedy.

4

u/cp5184 Aug 26 '26

It's the reason why if you broke the disc or lost it, or it just flat out stops working after many years, you aren't entitled to another free copy.

I own the valve orange box physical edition. If the discs break, I can go to steam, go to I think back up game files, and then burn my own copy of the orange box physical discs.

I think the term people often use is free as in beer in that you have the recipe and can make it yourself I guess.

Now as has been mentioned, gog is even better about this.

Players remind Sony that using term 'buy' with PlayStation games they don't actually own is misleading!

This is the most non-story of all time.

You know what people? You don't own the physical games either. They're also limited use license, just like movies.

Yes, yes, I know. If it's digital only and your console is always online something something account termination/revocation/services going offline. Sure, but the dispute of if you legally own a game or not goes back all the way to the beginning of video games in the first place.

If we don't own them, only own a license to use them, does that mean the publisher is on the hook to replace a broken physical media? TOS says no. Can I operate a for profit business using physical media? TOS says no, law says first sale doctrine so you can sell or rent your copy, but you can't do "mass screenings" and the like, whatever that means under the context of a video game. Makes more sense for movies.

I get people don't like the fully digital shift, and that's fine, but this article is ruminating 30+ year old problems.

u/Analogsilver Aug 25 '26

"You don't own it" has been the software user agreement since forever. Literally. I can't remember a single user agreement in the last 40 years that didn't say this. Even before there was downloadable software.

I guess no one today knows that.

13

u/B23vital Aug 25 '26

I think the difference like other have said is that physical discs cant be taken out of your possession, while downloadable content can be removed at any time without notice.

There needs to be law changes for this, if this is the way they want to go, fine, people can choose how they buy/dont buy games, but it needs to be clearer.

At this point i dont get why more people dont buy PC's (if money isnt an issue) as owning a console is becoming completely pointless

4

u/GodEmperorPotato Aug 25 '26

As someone who owns both console and pc. I game on console because its more convenient as I have them in the living room and my bedroom and also in my own space in the basement.  I use pc for gaming also but some days after work the last thing I wanna do is get back on a pc after being in one all day

8

u/meancoot Aug 25 '26

Sony could push an update today that will stop any specific disc game from ever running again.

Sure, you could still play as long as you never go online again and never try to play a newer disc based game that ships with the newer system software. But your ability to play a physical disc is ultimately as ephemeral as a digital license.

5

u/PurbulentTriest Aug 25 '26

No they can't because of the law.

3

u/MrShigsy89 Aug 26 '26 edited Aug 26 '26

I think people are getting far too hung up on the physical disk topic. It's not at all the core issue. With or without a physical disk, a development studio / publisher can mandate an active internet connection to play a single player game, and/or end support for multiplayer servers, essentially killing some games entirely. Your physical disk doesn't protect you from this at all.

What people should be discussing is regulations to manadate that non-multiplayer games and game modes will work offline forever, and that multiplayer servers (if they exist for a given game) are maintained for a minimum of X year's after game lunch. Any multiplayer game that kills off it's servers after this minimum period must opensource the standlone server component to allow the community to self host (and maintain) that service.

Steam has proven decades ago that a substantial game collection is dramatically more efficient to own digitally, particularly if you want to use it across the lifetime of multiple devices. We don't need disks, we need legal guarantees.

4

u/dwardu Aug 26 '26

If you do not log on to your PlayStation account in 36 months then Sony costume they have the right to delete your account and you lose games that you lawfully purchased. With no way to recover it. Yes it is pretty abhorrent what they’re doing.

The overwhelming majority of people are buying digital games. We took a vote by show of wallets and physical media lost. Capitalism worked as intended.

2

u/JennyWearsBlueJeans Aug 25 '26

My biggest issue with this is games are huge and PlayStation drives aren’t. I got a PS4 right when it came out, put Fallout 4 and Doom on there and the drive was like 2/3 of the way full. I spent the next decade deleting games to make room for new games, etc. This would be even more of a pain if all my games were digital as I’d have to re-download each one if I had deleted it and wanted to play it again.

2

u/Humorous-Prince Aug 25 '26

Probably don’t actually own the console either.

2

u/Gullible_Thing34 Aug 25 '26

2

u/UnInvertedSkyTower Aug 25 '26

Is that a threat Sony? Please don't think you're too big and loved to not start feeling it when people give up on you. Youre not all that

2

u/Brown_Star Aug 25 '26

It would be a shame if another gaming console were to rise up from the ashes and take over that market share.

Some gamers are too young to remember the cut throat 90's and early 2000s gaming console wars. I would love to see Sega resurrected from the dead! The genesis will always be in my top 3 of all time.

2

u/oman54 Aug 25 '26

So all that easy marketing n stuff they did back in the Xbox one PS4 days means nothing now

2

u/rossfororder Aug 26 '26

Sony are quickly digging holes, think Xbox circa 2013. This could absolutely kill their brand and instead they're speed running into it

2

u/Brave_Confection_457 Aug 26 '26

That most digital storefronts license content without actually selling it is nothing new

It's literally always been the case.

Look revoking access to the license out of nowhere sucks and I agree it's an issue but no customer in the history of video games has ever had anything but a license to use it within the developer's or creator's terms

2

u/Tibortoo Aug 26 '26

So I have a professional level Sony camera.
