Im pretty sure that those rules are for Peter Parker, not Spider-Man. Those rules apply to Peter Parker Spider-Man, but not other Spider-Men. I could be completely off the mark tho

That's not a different interpretation tho, that's just an established multiverse, plus the tweet not understanding what the creator actually said. Stan Lee said the original Spiderman wasn't gay because he wasn't written as such and shouldn't be made to be something he's not, which is what Kira was referring to. But, as you say, they are multiple Spidermen, and there are gay ones amongst them.
Moreso when most media like that nowadays is a multiverse, so technically speaking Petra Parker breaks shite of the canon, as it can be used as a justification, with no issue whatsoever, "yeah, this continuity belongs in an universe outside of the official ones"
There's a difference between writing a different version of spider-man as gay than making original 616 spider man suddenly change sexuality. Spider-Man is honestly the best example of how you could write a gay Peter Parker who is just in a different timeline and not have to retcon anything or mess it up.
Stan Lee specifically said that a gay Spider-Man needs to be a new character created specifically to be a gay Spider-Man not just making Peter Queer. Otherwise it would just be lazy representation just to slap a gay label on a preexisting character instead of building a character to be gay and having them deal with issues unique to gay people
The idea is that you can envision anybody under the mask, not that any alternate characterization can be applied to the predefined Peter Parker character without scrutiny
